Facing the Consequences1

چکیده
AS IN OTHER FIELDS OF POLITICS, MAJOR CHANGES IN THE JUSTICE SYSTEM tend to occur when there is not only a practical need and political support for change but also a theory or philosophy with which to justify new practices. The search for alternatives to the court system for dealing with young offenders is a good example. Practitioners and observers of the system for dealing with young offenders tend to talk of two basic models. The "justice" model has tended to see juvenile delinquency as a psychological problem whereby young offenders have exercised their free will inappropriately. The "welfare" model has tended to see the behaviour of young offenders as a sociological problem. Each swing of the policy pendulum between the "welfare" and "justice" models has been justified by theories of child psychology and beliefs about the deterrent effect of various treatments. A concern that young offenders were being labelled as criminals and thereby stigmatised encouraged the search for less formal procedures during the 1960s and 1970s. Concern that informal procedures potentially deprived young offenders of the right to due process subsequently encouraged the trend back towards a justice model. In the language of our debased political vocabulary, this oscillation between the welfare and justice models of dealing with young offenders has been seen to reflect a struggle between "liberal" or "leftist" values on the one hand and "conservative", "right-wing" or "authoritarian" values on the other. It is becoming clear, however, that this political language is no longer adequate. It encourages thinking and politicking that is confused rather than enlightened. The liberal democratic philosophy within which this debate takes place is an invaluable tradition. It tends, however, to emphasise individual rights at the expense of social obligations or duties. It draws a sharp distinction between public life and the private sphere. The legal system formally reflects this philosophy, and in recent debates about the legal justice

The Rate of Mutation of L5178Y Asparagine-dependent Mouse Leukemia Cells to Asparagine Independence and Its Biological Consequences1
LSI78Y mouse lymphoblastic leukemia cells normally require asparagine (ASN) for growth, but phenotypically stable ASN-independent cells are detectable at low fre quency by direct cloning, in ASN-free soft-agar medium, of cells from cultures that have been grown nonselectively in medium containing ASN. The rate of mutation in vitro to ASN independence was determined by the Luria-Delbruck fluctua...
متن کاملAn Enhanced Flux Treatment in Solving Incompressible Flow in a Forward-Facing Step
The aim of this paper is to give a detailed effect of several parameters such as step height, Reynolds number, contraction ratio, and temperature difference between the entrance and solid boundaries, of a forward-facing step. An accurate length of separation and reattachment zones are achieved. A finite-volume method (FVM) has been developed to study incompressible flow in a forward-facing step...
متن کاملComparative Study of Anchored Wall Performance with Two Facing Designs
The present study compared the performance of soldier pile and concrete bearing pad anchored wall facings. Using Abaqus finite element software, two case studies have been precisely represented for the facing designs and effects of the parameters of soil type, spacing of anchors and facings, surcharge and facing sizes were investigated. The analysis results indicate that the soldier pile method...
متن کاملSeismic Active Earth Pressure of Narrow Geosynthetic-Reinforced Backfill on Rigid Facing
In the narrow geosynthetic-reinforced retaining walls a stable rear wall exists in a short distance and so there is no enough space to extend appropriate length of reinforcements. In this case, the probability of overturning of retaining wall increases especially when subjected to earthquake loading. To increase the stability of the wall, reinforcements may be connected to the stable rear surfa...
متن کاملLES/FMDF of premixed methane/air flow in a backward-facing step combustor
In the present study, a hybrid Eulerian-Lagrangian methodology is utilized for large eddy simulation (LES) of premixed fuel/air flow over a three-dimensional backward facing step (BFS). The fluid dynamic features are obtained by solving the Eulerian filtered compressible transport equations while the species are predicted by using the filtered mass density function method (FMDF). Some scalar f...
